1. General Provisions

1.1. These Terms and Conditions define the rules for using the online store available at polenpolakmeble.pl, operated by Polak Meble Sp. z o.o..
1.2. The online store sells furniture and home interior products.
1.3. The Terms are prepared in accordance with Polish and EU consumer protection laws, including:

  • the Act on Consumer Rights (Dz.U. 2014, item 827 as amended),
  • the Civil Code (Kodeks Cywilny),
  • and the GDPR (EU Regulation 2016/679).
    1.4. Using the Store implies acceptance of these Terms.

2. Definitions

For the purpose of these Terms:

  • Store – the online platform available at polenpolakmeble.pl.
  • Seller / Company – Polak Meble Sp. z o.o.
  • Customer / Consumer – any natural or legal person placing an order or using the Store.
  • Product – any item offered for sale through the Store.
  • Order – a declaration of intent made by the Customer to purchase one or more Products.
  • Account – an individual profile created in the Store system (optional).
  • Business Days – Monday through Friday, excluding public holidays in Poland.

3. Scope of Activity

The Store sells:

  • Furniture and interior accessories for home and office use.
  • Products are available within the European Union.

Each product is described with its essential features, price (including VAT), and availability.

4. Orders and Payments

4.1. Orders can be placed 24/7 via the website.
4.2. The order becomes binding once confirmed by the Seller.
4.3. Accepted payment methods:

  • Credit/Debit cards (via Stripe, PayU, or Przelewy24),
  • Bank transfer,
  • PayPal (where available),
  • Cash on delivery (if specified).
    4.4. All prices are in EUR and include applicable VAT.
    4.5. The Seller reserves the right to change prices without prior notice.

5. Delivery

5.1. Delivery is carried out through trusted courier services (DPD, InPost, DHL, or similar).
5.2. Orders are shipped within 2–10 business days, depending on product availability.
5.3. Delivery costs are displayed during checkout before final confirmation.
5.4. The Customer is obliged to check the shipment upon delivery. In case of visible damage, a complaint report should be filed immediately with the courier.

6. Withdrawal from the Contract (Right of Return)

6.1. Consumers have the right to withdraw from the contract within 14 days of receiving the product without providing any reason.
6.2. To exercise this right, the Customer must send a withdrawal statement via email to info@polenpolakmeble.pl.
6.3. Returned goods must be unused, in original packaging, and sent back within 14 days after withdrawal.
6.4. Refunds will be processed within 14 days after the returned goods are received.
6.5. Custom-made or personalized products are not eligible for return, in accordance with Article 38 of the Polish Consumer Rights Act.

7. Complaints and Warranty

7.1. The Seller is responsible for any defects in products under the warranty and statutory guarantee as per Polish law.

7.3. The complaint should include the order number, product description, and photos of the defect.
7.4. The Seller shall review the complaint within 14 days and inform the Customer of the decision.

8. Account and User Data

8.1. The Customer may create an account to view orders and save preferences.
8.2. The Customer is responsible for maintaining the confidentiality of login credentials.
8.3. Personal data is processed in accordance with the Privacy Policy and GDPR.

9. Liability

9.1. The Seller is not liable for temporary unavailability of the Store due to maintenance or technical issues beyond its control.
9.2. The Seller shall not be liable for losses resulting from incorrect use of the product by the Customer.

10. Final Provisions

10.1. Polish law applies to all contracts concluded via the Store.
10.2. Any disputes arising from the use of the Store will be resolved by the competent court according to the provisions of the Polish Civil Code.
10.3. Consumers may use out-of-court complaint and redress procedures, including mediation and arbitration before the Trade Inspection (Inspekcja Handlowa).
10.4. The Company reserves the right to amend these Terms at any time, provided that the changes do not affect previously concluded contracts.
